Terms and conditions
Version in force since 1 July 2024. These general terms and conditions govern all services of Success Driving School: first aid courses, theory, sensibilisation (CTC), motorcycle training and driving lessons. Any registration, booking or purchase implies their acceptance. This English version is provided for convenience: in the event of any discrepancy, the French version shall prevail.
General provisions
These general terms and conditions ("GTC") govern all services offered by Success Driving School (hereinafter "the Driving School"), in particular first aid courses, theory courses, sensibilisation courses (CTC), practical motorcycle training and car driving lessons.
Any registration, booking or purchase of a service or package implies that these GTC have been read and accepted. The Driving School may amend these GTC. Amendments apply to new registrations and bookings made after they come into force, subject to mandatory legal provisions.
Article 1 – Registration
- Any registration for a service of the Driving School is personal and nominative.
- The participant undertakes to provide accurate, complete and up-to-date information when registering.
- The participant is responsible for checking the information relating to their registration, in particular their contact details, the dates and times of the courses and the documents required for their training.
- Any change to personal or administrative information must be communicated to the Driving School as soon as possible.
- The Driving School may refuse a registration when the legal or administrative conditions required to take part in the training are not met.
Article 2 – Punctuality
- The participant must arrive at the training location at least 10 minutes before the start of the course or lesson.
- This time allows in particular for the necessary administrative checks and ensures that the training starts smoothly.
- A delay of more than 10 minutes may result in refusal of access to the course or exclusion from the service.
- For individual driving lessons, any delay by the student reduces the effective duration of the lesson accordingly. The lesson ends at the originally scheduled time.
- No automatic extension may be demanded on account of a delay by the participant.
Article 3 – Cancellation and rescheduling
- Any cancellation or rescheduling request must be made at least 72 working hours before the start of the service.
- The request must be made by telephone to the office during opening hours or, for driving lessons, directly to the instructor where this option has been expressly agreed.
- Requests made by e-mail, SMS or any other messaging service are not considered valid for a cancellation or rescheduling, unless previously agreed by the Driving School.
- Any cancellation or rescheduling request made outside the deadline is considered a late cancellation.
- In the event of a late cancellation or absence, the service is due in full. When it is part of a package, it may be deducted from the available balance.
Article 4 – Illness, accident and exceptional circumstances
- Illness, an accident or the presentation of a medical certificate does not automatically entitle the participant to a refund, a free cancellation or a rescheduling when the deadline set out in Article 3 has not been met. Fees may apply.
- The Driving School may however, exceptionally and depending on the circumstances, accept a rescheduling or offer a commercial solution.
- Any exceptional decision taken by the Driving School does not constitute a precedent or an acquired right for future services.
Article 5 – Fitness to take part in the training
- The participant must attend the training in a physical and psychological condition compatible with the smooth running of the course.
- It is forbidden to take part in any driving activity under the influence of alcohol, drugs or medication likely to impair the abilities required for driving.
- The teacher or instructor may refuse access to a service or interrupt it when they consider that the participant's condition presents a risk to their own safety, that of the teacher, that of the other participants or that of other road users.
- In this case, the service may be considered due.
Article 6 – Conduct
- The participant must behave respectfully towards the teachers, instructors, other participants, staff members and partners of the Driving School.
- They must follow the instructions given by the teachers and instructors as well as the applicable safety rules.
- Any person who disrupts the smooth running of a training session, behaves in a violent, threatening or seriously disrespectful manner, or compromises the safety of others may be excluded from the service.
- In the event of an exclusion justified by the participant's conduct, no refund, credit or compensation will be granted.
Article 7 – Telephones and electronic devices
- Mobile phones and other electronic devices must be set to silent mode during courses.
- Their use may be limited or forbidden by the teacher or instructor.
- Any audio, video or photographic recording of a course, a teacher, an instructor or another participant is forbidden without prior authorisation.
Prices & payment
Article 8 – Prices
- The applicable prices are those communicated by the Driving School at the time of registration or booking.
- Prices may be changed for new registrations and bookings.
- Any administrative fees, exam fees or third-party services are not included in the price of the courses, unless otherwise indicated.
Article 9 – Payment
- Services must be paid for according to the payment methods offered by the Driving School.
- Payment may in particular be made online on the Driving School's website or at the office.
- Proof of payment may be requested before the start of the service.
- In the event of payment by bank transfer, the participant must be able to present proof of payment.
- In the event of payment in cash, the participant must bring the exact amount.
- The Driving School may suspend new bookings when a participant has unpaid services.
Article 10 – Packages
- Services purchased as a package must be paid for in advance, unless otherwise agreed.
- Unless otherwise indicated at the time of purchase, packages are valid for 18 months from the date of purchase.
- Services not used by the end of the validity period may lose their validity.
- Packages are personal and may not be transferred to another person without the prior agreement of the Driving School.
- The specific conditions communicated when a package is purchased form an integral part of it.
- Unless required by mandatory legal provisions or otherwise agreed by the Driving School, unused services in a package do not give rise to an automatic refund at the end of its validity period.
First aid
Article 11 – Duration and certificate
- The first aid course takes place over a total duration of 10 hours.
- Attendance at all scheduled hours is compulsory in order to obtain the corresponding certificate.
- The certificate is issued only when the required participation and attendance conditions are met.
- In the event of partial absence or early departure, the certificate may not be issued and the service remains due.
- The participant is responsible for checking the accuracy of the information on their certificate.
Article 12 – Duplicates and corrections
- Any request for a duplicate of a certificate is charged CHF 30.–.
- Any new certificate request made necessary by incorrect information provided or not checked by the participant may also be charged CHF 30.–.
- Any request for a duplicate or a new certificate must be made in writing to the Driving School.
Article 13 – Specific participation conditions
- A delay of more than 10 minutes may result in refusal of access to the course.
- The instructor may exclude a participant whose conduct disrupts the smooth running of the course or compromises the safety of the session or of the other participants.
- In the event of exclusion or refusal of access resulting from conduct, lateness or non-compliance with the participation conditions, no refund or compensation will be granted.
Theory
Article 14 – Duration
- The theory course takes place over a total duration of 6 hours.
- Depending on the offer chosen, the participant may attend the course as many times as they wish during the validity period of their registration or package.
- This possibility is subject to the availability of the sessions offered by the Driving School.
- This commercial offer does not change the legal requirements applicable to obtaining a driving licence.
Article 15 – Participation
- The participant must arrive at the course at least 10 minutes before the scheduled time.
- A delay of more than 10 minutes may result in refusal of access to the course.
- The participant must follow the teacher's instructions and the rules of conduct set out in these GTC.
- In the event of exclusion resulting from the participant's conduct, no refund or compensation will be granted.
Sensibilisation (CTC)
Article 16 – Purpose and duration
- The sensibilisation course, also known as the traffic theory course (CTC), aims to give future drivers a better understanding of the risks associated with road traffic and to encourage responsible, anticipatory behaviour that is respectful of other road users.
- The course takes place over a total duration of 8 hours, in accordance with the applicable requirements.
- The course is given in accordance with the applicable legal requirements and directives.
- A CTC completed since 1 January 2021 is valid indefinitely under the requirements currently in force.
- In the event of a change in the legal requirements, those requirements prevail over these GTC.
Article 17 – Compulsory documents
- Registration for the CTC is personal and nominative.
- The participant must provide the information and documents required for their registration.
- The participant must check the accuracy of their personal data, the date of their course and the validity of their learner's permit.
- The learner's permit must be presented physically when required.
Article 18 – Participation
- The participant undertakes in particular to: take an active part in discussions and exercises; follow the teacher's instructions; respect the other participants; behave in a way that allows the course to run smoothly; not deliberately disrupt the training.
- A delay of more than 10 minutes may result in refusal of access to the course.
- The teacher may exclude any participant whose conduct disrupts the course or compromises safety.
- In the event of refusal of access or exclusion resulting from the participant's conduct, no refund or compensation will be granted.
Motorcycle
Article 19 – Course organisation
- The basic practical motorcycle training, with a total duration of 12 hours, is divided into three 4-hour parts: Part 1 (4 hours), Part 2 (4 hours), Part 3 (4 hours).
- The parts must be taken in the order set by the Driving School.
- Exclusion from or non-participation in one part may make it impossible to take part in the following parts.
Article 20 – Vehicle
- The participant must attend with a motorcycle that meets the legal requirements corresponding to their learner's permit.
- They must be in possession of their learner's permit and of the vehicle's registration document.
- The vehicle must be in good working order and meet the applicable safety requirements.
- The participant must in particular check the condition of the brakes, tyres, lights and other safety elements.
- The vehicle's tank must be filled up before the start of the course.
- The basic practical training courses are not introductory courses. The participant must already be in control of their vehicle before taking part in the training.
Article 21 – Equipment
- The participant must wear equipment suitable for riding a motorcycle, comprising as a minimum: a homologated helmet; a suitable jacket; gloves; trousers; closed shoes.
- Clothing suited to the weather conditions, in particular rain gear, is recommended.
Article 22 – Safety
- The participant must follow the instructor's instructions and the safety rules.
- The instructor may refuse access to the course when a vehicle, a piece of equipment or the participant's conduct does not meet the safety requirements.
- Riding under the influence of alcohol, drugs or medication likely to impair driving abilities is strictly forbidden.
- An exclusion resulting from non-compliance with the safety requirements may result in the loss of the service without a refund.
Car
Article 23 – Lesson duration
- A car driving lesson, manual or automatic, lasts 45 minutes.
- Double lessons or formats of a different duration may be offered by the Driving School.
Article 24 – Access conditions
- The student must be legally authorised to drive the vehicle used for their training.
- The student must be in possession of their learner's permit or of any other document legally authorising them to drive.
- The required document must be available for presentation to the instructor at every lesson.
- The student is personally responsible for the validity of their permit and of any document required for their training.
- The Driving School may refuse a lesson when the legal conditions for driving are not met.
Article 25 – Booking
- Lessons may be booked online, by telephone or directly with the instructor, according to the arrangements offered by the Driving School.
- A booking is final once confirmed.
- The student is responsible for checking the date, time and place of the appointment.
Article 26 – Cancellation and rescheduling
- Any cancellation or rescheduling request must be made at least 72 working hours before the start of the lesson.
- Requests must be made by telephone to the office during opening hours or directly to the instructor where this option is provided for.
- Requests by e-mail, SMS or any other messaging service are not considered valid, unless previously agreed.
- In the event of a late cancellation or absence, the lesson is due in full.
- When it is part of a package, the lesson may be deducted from the number of remaining services.
Article 27 – Driving School vehicle
- When the lesson takes place in a vehicle belonging to the Driving School, that vehicle is maintained and insured in accordance with the applicable requirements.
- The student must treat the vehicle with care and follow the instructor's instructions.
- Any damage caused deliberately or resulting from wrongful conduct may engage the student's liability within the limits of the applicable law.
Article 28 – Private vehicle
- When the training takes place in a private vehicle, the participant must hold the documents required to drive and use the vehicle.
- The vehicle must be in good working order and meet the applicable safety requirements.
- The participant must in particular check the fuel, the necessary fluid levels, the lights, the tyres and the general condition of the vehicle.
- The Driving School or the instructor may refuse a vehicle that does not meet the necessary safety conditions.
- In this case, the service may be considered due.
- A Driving School vehicle may be offered for hire subject to availability and the applicable price.
Insurance
Article 29 – Insurance
- During driving lessons in the Driving School's vehicles, the student is covered by the vehicle's insurance in accordance with the conditions and limits of the applicable insurance policies.
- Where the coverage conditions allow, no excess is charged to the student for material damage occurring during a driving lesson or a practical exam.
- The student's criminal, administrative or personal liability remains reserved.
Article 30 – Student's responsibility
- The student must comply with the traffic rules and with the instructor's instructions.
- Any fine, penalty or consequence resulting from the student's own wrongful conduct remains at their expense.
- The Driving School does not guarantee success in any theory or practical exam.
- Success depends in particular on the level of preparation, personal aptitude, the regularity of the training and the candidate's behaviour.
Exams
Article 31 – Exam preparation
- The Driving School may recommend that the student sit the exam when it considers that their level of preparation is sufficient.
- This recommendation does not constitute a guarantee of success.
- The student remains responsible for meeting the administrative conditions required to register for the exam.
- Exam fees, when charged by the authorities, are not included in the price of the courses unless otherwise indicated.
Article 32 – Vehicle for the practical exam
- When the Driving School offers to provide a vehicle for the practical exam, this service is subject to a specific price.
- Depending on the format chosen, this service may include preparation, the provision of the vehicle and accompaniment by the instructor.
- The applicable conditions and prices are communicated before booking.
Duplicates
Article 33 – Duplicates and documents
- A duplicate of a course certificate is charged CHF 30.–.
- The request must be made in writing to the Driving School.
- When a document has to be reissued as a result of incorrect information provided or not checked by the participant, the CHF 30.– fee may also apply.
Cancellation by the school
Article 34 – Rescheduling or cancellation of a session
- The Driving School may exceptionally reschedule or cancel a service, in particular in the event of: exceptional circumstances; an insufficient number of participants; the unavailability of the teacher or instructor; a breakdown or technical problem; dangerous weather or road conditions; force majeure; any other circumstance beyond its control.
- The participant is informed as soon as possible.
- Wherever possible, a new date is offered.
- When a service cannot be rescheduled, the refund arrangements are determined according to the circumstances and the applicable legal provisions.
Personal data
Article 35 – Data processing
- The Driving School processes the personal data required for the management of registrations, the organisation of training, the follow-up of participants, invoicing, communication and compliance with its legal obligations.
- Data is processed in accordance with the applicable Swiss data protection legislation.
- The Driving School takes appropriate measures to protect personal data against unauthorised access, use or processing.

Final provisions
Article 36 – Amendment of the general terms and conditions
- The Driving School may amend these GTC, in particular as a result of legal, administrative, organisational or commercial changes.
- The new GTC apply to new registrations and bookings made after they come into force.
- Mandatory legal provisions remain reserved.
Article 37 – Applicable law and jurisdiction
- These GTC are governed by Swiss law.
- Subject to the mandatory places of jurisdiction provided for by law, any dispute relating to the services of the Driving School falls within the remit of the competent authorities in accordance with the applicable legal rules.
- The parties will endeavour, as far as possible, to seek an amicable solution before any proceedings.
Article 38 – Acceptance
By registering for a service, booking a lesson or purchasing a package, the participant acknowledges that they have read and accept these general terms and conditions. These general terms and conditions form an integral part of the contractual relationship between Success Driving School and the participant.
